IAS Officer Fined ₹1,00,000 for Naming LG in Petition

Jammu: The Central Administrative Tribunal (CAT), Jammu Bench, dismissed a petition filed by senior IAS officer Ashok Kumar Parmar and imposed a ₹1,00,000 penalty on him for naming the Lieutenant Governor of Jammu and Kashmir in his case.

The case pertained to adverse remarks made in Parmar's service book by the former Chief Secretary, for which he already has two pending petitions.

Judicial Member Rajinder Dogra, who issued the order, said that the Indian Constitution's Article 361(4) provides immunity to the President and Governors, preventing them from being sued or served notices while in office.

Parmar had named the Lieutenant Governor and seven top officials in his petition, which the CAT deemed improper and unnecessary, noting that these officials were carrying out their official duties and had not been accused of any wrongdoing.

The tribunal criticized Parmar for misusing the judicial process, stating that as a senior IAS officer, he should be aware of legal fundamentals.

CAT is a specialized tribunal established under the Administrative Tribunals Act of 1985 to adjudicate disputes related to the service matters of central government employees and other issues related to the administration of justice within the framework of public service law. While it deals with administrative issues, it operates within the judicial framework and has the authority to make legal decisions and rulings.
