New Delhi/Srinagar: The Administration of Jammu and Kashmir run by New Delhi will form State Investigation Agency – a new specialised investigating nodal agency to probe Terrorism and linked cases while coordinating with the National Investigation Agency (NIA) and other Central Agencies, Indian Express Reported.
"Offences pertaining to acts and provisions of the IPC are included in the purview of the agency including The Unlawful Activities (Prevention) Act, The Explosive Substances Act, the SAARC Convention (Suppression of Terrorism) Act, Weapons of Mass Destruction and their Delivery Systems (Prohibition of Unlawful Activities) Act.
"Offences of terrorism links; all terrorist acts including terrorist financing and circulation of high quality fake India currency notes."
"Moreover, Terrorism conspiracy cases relating to Terrorism Propaganda, False Narrative, Mass Incitement, Spreading Disaffection and enmity against the Indian Union will be probed by SIA."
"The SIA Directorate will be set up in J&K with the head of the CID wing as its ex-officio Director and it’s officers will be deputed by the government."
"It will be mandatory for all Police officers posted in police stations to intimate the SIA immediately on registration of terrorism-related cases, and about cases where terrorism linkage surfaces during the investigation."
It shall take such measures necessarily [for] speedy and effective investigation and prosecution of terrorism related cases.”
"The agency will be set up aside from the CID and allied agencies working in the UT."
"Sources in the administration said that the need for setting up a new agency was felt “for specialised investigation” into terror cases not referred to the NIA," Indian Express reported on Monday.
"In cases, not taken up by the NIA- the DGP of J&K will determine whether the case is fit to be investigated by SIA but in consultation with the SIA while considering gravity of the offence, progress of investigation and other relevant factors."
Meanwhile, the SIA will also be the agency for investigation and trial of offences in cases which are transferred to the UT in terms of section 7 of the National Investigation Act, 2008.
