Srinagar, May 5 —The Lieutenant Governor’s office has returned the proposed Transaction of Business Rules (TBR) file to the Jammu and Kashmir government—a key document outlining administrative procedures for governance—seeking clarifications on procedural compliance and specific provisions that may conflict with the Jammu and Kashmir Reorganisation Act.
The file was earlier cleared by the J&K Cabinet and sent to Raj Bhawan for the approval in March.
Sources confirmed that the LG’s office flagged specific clauses, particularly those related to the posting and transfer of IAS officers, as conflicting with the Jammu and Kashmir Reorganisation Act, 2019. These powers, under the Act, fall within the LG’s discretionary domain.
In the Union Territory setup, key subjects such as law and order, public order, and All India Services fall under the exclusive authority of the Lieutenant Governor.
The amended Business Rules also lay out the mechanism to address any disagreements that may arise between the LG and either the Council of Ministers or an individual minister.
The Omar Abdullah-led government took over four months to draft the Business Rules, a requirement mandated by the Jammu and Kashmir Reorganisation Act.
