Srinagar, March 14 — A Tangmarg resident has moved a Srinagar court against a fashion show in Gulmarg over obscenity and public alcohol consumption during Ramadan, with the court issuing notices to two designers, the Editor of ELLE India, and unidentified models.
The complaint, filed by Aadil Nazir Khan, a Tangmarg resident currently in Srinagar, through advocate Naveed Bukhtiyar, accuses the event’s organizers of violating Sections 296 and 299 of the Bharatiya Nyaya Sanhita (BNS) and Section 50-A of the Jammu and Kashmir Excise Act, 1958.
Section 296 of BNS penalizes obscene acts in public, including performances and expressions that may cause annoyance, with up to three months of imprisonment, a fine, or both. Besides, Section 50-A of the Jammu and Kashmir Excise Act regulates the consumption and sale of alcohol in the region.
“Perusal of the complaint reveals that the complainant seeks action against three proposed accused for organizing a fashion show in which obscene and inappropriate content was displayed,” said Faizan-I-Nazar, Special Mobile Magistrate, Srinagar Railway Magistrate, Kashmir.
The court noted that before taking cognizance of the case, it is required to hear the accused under Sub-Section (1) of Section 223 of BNSS, 2023. Accordingly, notices have been issued for their appearance via registered post.
