Court allows MP Engineer Rashid to attend Budget Session

Delhi court grants custody parole to Baramulla MP lodged in Tihar in terror-funding case

Srinagar, Jan 24 — A Delhi court on Saturday allowed Baramulla Member of Parliament Engineer Rashid, who is lodged in Tihar Jail in a terror-funding case, to attend the upcoming Parliament Budget Session under custody parole, subject to earlier conditions.

Additional Sessions Judge Prashant Sharma of the Patiala House Courts granted custody parole to Rashid for the entire Budget Session, scheduled to begin on February 28.

As per the court order, Rashid will be taken from Tihar Jail to Parliament only on days when the House is in session and will remain under official custody throughout the period.

“The applicant shall be escorted from jail to Parliament and back on days when the House is in session and shall remain in custody at all times,” the court said.

The court added that the issue of expenses related to Rashid’s transportation during custody parole would be decided by the Delhi High Court, where a similar matter concerning costs incurred during the previous Monsoon Session is pending.

Rashid was represented by advocates Vikhyat Oberoi, Nishita Gupta, Shivam Prakash and Ravi Sharma.

Engineer Rashid was arrested in 2019 by the National Investigation Agency and booked under the Unlawful Activities (Prevention) Act, becoming the first mainstream politician to be charged under the anti-terror law.

Sheikh Abdul Rashid, popularly known as Engineer Rashid, contested the 2024 Lok Sabha elections as an independent candidate while in jail and won the Baramulla parliamentary seat. He secured 4,52,812 votes, defeating National Conference leader Omar Abdullah, who polled 2,53,888 votes.
